The Senior Counsel, Global Commercial Legal - U.S. Market Access and Pricing is responsible for developing legal strategy and support for the Market Access organization, with a substantial focus on government price reporting. Provides counsel on legal, compliance, and regulatory issues, primarily federal price reporting, Anti-Kickback Statute, and False Claims Act.
Responsibilities:
- Counsel the Government Price Reporting function on legal, regulatory, and compliance issues tied to federal government price reporting requirements.
- Counsel U.S. Market Access and Pricing functions on price reporting, Anti-Kickback Statute, and False Claims Act matters.
- Provide strategic legal counsel to senior management on product pricing and access matters.
- Prepare, review, and negotiate complex government agreements; support development of policies/training and conduct training; resolve routine matters with supervision and assist on complex cross-functional issues.
- Build deep knowledge of the business and supported client areas; monitor changes in law affecting them.
- Resolve legal issues using negotiation and legal expertise; communicate project developments to legal leadership; execute responsibilities timely.
- Select and direct outside counsel; define project objectives and manage projects.
- Advise Managers/Directors; matters may directly impact business activities and operations.
- Operate within budget; develop budgets for assigned legal matters with supervision when needed.
Qualifications:
- Law degree from an ABA-accredited law school and in good standing with the state bar where the office is located (or ability to gain licensure).
- Minimum 7+ years relevant legal experience; previous pharmaceutical experience required.
- Proficiency in government price reporting (AMP, Best Price, ASP, 340B) and federal health care program contracting (e.g., Medicaid, VA).
- Strong communication skills; comfortable with high-visibility, high-impact projects.
- Ability to identify practical legal solutions independently and work effectively in high-pressure, matrixed environments.
