Role Summary

Legal Senior Counsel, Market Access. Provide proactive strategic and tactical legal support to the business in market access, government pricing, and policy topics. Support across Market Access, Trade & Distribution, Government Pricing, Government Affairs & Public Policy, and colleagues supporting the clinical pipeline. Remote US location.

Responsibilities

  • Provide Advice and Counsel to Business Partners
    • Advise business partners on commercial initiatives that advance strategy while addressing legal risks and protecting integrity and reputation
    • Provide legal advice on:
      • Market access and reimbursement issues, including contracting with customers involved in distribution
      • Anti-Kickback Statute and other US healthcare compliance laws
      • Medicaid, Medicare, 340B, Veterans Health Care Act obligations
      • Government pricing topics, price reporting policies
      • CMS and Medicaid final rules, public comments on proposed rules
      • Federal/state legislation affecting market access, pricing, reimbursement, and price transparency
      • Specialty distributors/pharmacies contracting
      • Data/projects with customers
      • Brand planning and business operation plans
      • Evolving healthcare legislation and enforcement landscape
      • Collaboration with legal colleagues supporting commercial, pipeline, and privacy
      • Review internal/external materials as needed
  • Contribute to the Legal & Compliance Department
    • Participate in L&C department projects and committees
    • Share information/knowledge via group presentations and discussions

Qualifications

  • JD from an ABA-accredited law school
  • Member of a state bar
  • Minimum 8 years post-JD experience advising on life sciences/biopharma matters
  • 3 years of law firm experience in a fast-paced environment
  • Experience with market access statutes/regulations, including anti-kickback, Medicaid/340B/Veterans programs, price transparency, OIG guidance, False Claims Act
  • Strong communication skills and ability to tailor legal advice to lawyers and non-lawyers
  • Advanced contracting/redlining skills with attention to detail
  • Analytical, problem-solving, and multi-tasking abilities with quality and timeliness
  • Experience managing outside counsel and budgeting
  • Experience advising on cell/gene therapies and/or specialty medicines preferred
