Role Summary

Legal Senior Counsel, Market Access provides expert advice and counseling on market access, government pricing, and policy topics to support the business. Collaborates with Market Access, Trade & Distribution, Government Pricing, Government Affairs & Public Policy, and pipeline teams in a US remote setting.

Responsibilities

  • Provide Advice and Counsel to Business Partners: advise on commercial initiatives while addressing legal risks and protecting integrity and reputation
  • Provide legal advice on:
    • Market access and reimbursement issues, including contracting with customers involved in distribution
    • Anti-Kickback Statute and US healthcare compliance laws
    • Medicaid, Medicare, 340B, Veterans Health Care Act obligations
    • Government pricing topics, price reporting policies, and reasonable assumptions documents
    • CMS/Medicaid final rules and correspondence, public comments on proposed rules
    • Federal/state legislation impacting market access, pricing, reimbursement, and transparency
    • Specialty distributors and pharmacies contracting
    • Data/projects with customers
    • Brand planning and business operation plans
    • Staying abreast of healthcare legislation and enforcement landscape
    • Collaborate with legal colleagues in commercial, pipeline, and privacy for comprehensive advice
    • Review materials for internal and external use

Qualifications

  • JD from ABA accredited law school
  • Member of a state bar
  • Minimum 8 years post-JD experience in life sciences, pharma, or related fields
  • 3 years of law firm experience in a fast-paced environment
  • Experience with market access statutes/regulations including anti-kickback, Medicaid/340B, Veterans programs, state pricing transparency, OIG guidance, False Claims Act
  • Strong communication skills with ability to advise both lawyers and non-lawyers; business-focused
  • Advanced contracting/redlining skills and attention to detail
  • Excellent analytical, problem-solving, and organizational skills; capable of handling multiple responsibilities and meeting deadlines
  • Experience managing outside counsel and budgeting
  • Experience advising on cell/gene therapies and/or specialty medicines is highly desirable
