Key Responsibilities
- Advise business partners on commercial initiatives by advancing company strategy while addressing legal risks and protecting integrity and reputation.
- Provide legal advice and counsel on:
- Statutory and regulatory obligations under Medicaid, Medicare, 340B program, Veterans Health Care Act
- Market access and reimbursement issues
- Government pricing (price reporting compliance policies and reasonable assumptions documents)
- CMS final rules/correspondence, including letters and comments on proposed rules and guidance
- Federal and state legislation impacting market access, pricing, and reimbursement, including state drug price reporting/transparency laws
- Services and contracting relating to specialty distributors and specialty pharmacies
- Data and special projects; brand strategic planning and business operation plans
- Evolving healthcare legislation, regulations, and enforcement landscape
- Provide legal counsel and strategic support for development/negotiation/administration of pharmaceutical commercial contracts with:
- Commercial and government payers, PBMs, GPOs, specialty pharmacies/distributors, wholesalers/distribution partners, IDNs, health systems/providers, and patient support/vendor partners
- Review/draft/negotiate rebate agreements, value-based/outcomes-based agreements, administrative service agreements, distribution agreements, data licensing agreements, patient support agreements, and other market access-related contracts.
- Ensure compliance with laws and company policies, including the Anti-kickback Statute.
- Collaborate with Legal/Compliance; participate in Medical Legal Review; counsel on labeling/promotional/comparative claims, health economic info, scientific exchange, and clinical data communications.
- Contribute to Legal & Compliance projects/committees; share knowledge with peers/managers.
Qualifications (Required)
- JD from an ABA accredited law school
- Member of a state bar
- Minimum 8 years post-JD experience advising on legal matters in a life sciences space (law firm and/or in-house)
- Government price reporting experience
Preferred
- Familiarity with HEOR, value communications, and market access promotional considerations
- Experience advising on statutes/regulations/guidance for market access (Medicaid, 340B, Veterans Administration, anti-kickback laws, state drug pricing transparency laws, OIG guidance/advisory opinions, False Claims Act, PhRMA Code)
- Significant experience with pharmaceutical contracting across payers/PBMs/GPOs/specialty channels/IDNs/providers
- Demonstrated experience with market access, rebate, distribution, administrative services, data, patient support, and value-based contracting
- Experience advising on specialty medicines
