Senior Counsel, Commercial Law (Hybrid)
Responsibilities:
- Provide hands-on, day-to-day legal support and business partnership for pre-launch, market access, patient support programs, materials review (advertising/promotion and medical/scientific communications), and government programs.
- Advise Commercial and Medical Affairs on product launch and market entry, including state and federal laws (Anti-kickback Statute, False Claims Act, OIG guidance, PhRMA Code, state drug pricing transparency).
- Advise on distribution/trade/channel strategy (specialty pharmacies, distributors, wholesalers, GPOs, PBMs); compliant patient support programs; pricing/coverage/reimbursement (Medicare Parts B & D, Medicaid, Veterans Health Care Act).
- Advise on government pricing (MDRPs—AMP/Best Price impacts; PHS 340B; FSS contracts), including FAR/Veterans Health Care Act compliance.
- Review promotional/medical/training/disease awareness materials for compliance.
- Assist with government price reporting audits.
- Draft, review, and negotiate healthcare and commercial agreements (vendors, HCPs, centers of excellence, specialty pharmacies, patient support vendors, payor/distributor/GPO/wholesaler agreements, sponsorship/grants/charitable contributions) to ensure compliance.
- Develop policies and training; support a culture of compliance; contribute to Commercial Legal Team initiatives.
Qualifications:
- J.D. from an accredited law school; Massachusetts bar member in good standing.
- 10+ years in biotech/pharma/life sciences with product development and U.S. commercialization; early-stage in-house experience required; first launch experience preferred.
- Strong knowledge of U.S. healthcare laws for commercialization/launch (e.g., FCA, Anti-Kickback, OIG, Sunshine Act, FCPA, transparency, pricing).
