Role Summary
Legal Senior Counsel, Market Access. Provide proactive strategic and tactical legal support to the business in market access, government pricing, and policy topics. Support business partners across Market Access, Trade & Distribution, Government Pricing, Government Affairs & Public Policy, and colleagues supporting the clinical pipeline. Remote in the US.
Responsibilities
- Provide Advice and Counsel to Business Partners
- Advise business partners on commercial initiatives while addressing legal risks and protecting integrity and reputation
- Provide legal advice on:
- Market access and reimbursement issues, including contracting with customers in the distribution of medicines
- Anti-Kickback Statute and other US healthcare compliance laws
- Medicaid, Medicare, 340B, Veterans Health Care Act obligations
- Government pricing topics, including price reporting policies and reasonable assumptions
- CMS/Medicaid final rules and related correspondence
- Federal and state legislation impacting market access, pricing, reimbursement, and transparency
- Services and contracting with specialty distributors and pharmacies
- Data and projects with customers
- Brand planning and business operation plans
- Evolving healthcare legislation and enforcement landscape
- Collaborate with legal colleagues across commercial, pipeline, and privacy
- Review materials for internal and external use
Qualifications
- JD from an ABA-accredited law school
- Member of a state bar
- Minimum 8 years post-JD experience in life sciences law (in-house or law firm, or both)
- 3+ years in a fast-paced environment
- Experience advising on market access statutes, regulations, and guidance, including anti-kickback laws, Medicaid/340B/Veterans programs, state drug pricing transparency, OIG guidance, and False Claims Act
- Strong written and verbal communication, with business-oriented legal advice
- Advanced contracting and redlining skills with attention to detail
- Analytical, problem-solving, and organizational skills to manage multiple priorities
- Experience managing outside counsel within budget
- Experience providing legal advice on cell and gene therapies or specialty medicines is highly desirable
