Position Summary
- Director, Commercial Counsel supporting development and commercialization of transformative therapies for rare diseases.
Responsibilities
- Support the commercial organization: promotional material review; commercial effort/program risk assessment; counsel on advertising, promotion, sales, and marketing.
- Draft, review, and negotiate commercial agreements (grants/corporate giving, licenses, payor/government pricing, commercial enablement).
- Maintain and enhance commercial policies, procedures, and internal controls.
- Provide legal support for commercial growth activities (named patient programs, distribution efforts).
- Partner cross-functionally with Commercial, Regulatory, Finance, and HR to structure/negotiatge agreements aligned with commercial objectives.
- Identify and mitigate legal risks; advise on FDA and OIG regulations and industry codes.
Regulatory & Compliance
- Advise on healthcare/regulatory/compliance matters, including promotional review, transparency laws, and interactions with HCPs/patient advocacy groups.
- Support development/implementation of patient and healthcare provider interaction policies and training.
- Assist with internal investigations and regulatory inquiries.
Risk Management & Corporate Support
- Contribute to organization-wide risk assessments/mitigation.
- Manage outside vendor relationships (transparency codes, quality, efficiency, cost).
- Enforce/train on privacy laws (e.g., GDPR, CCPA) and advise on compliance best practices (data collection, storage, sharing).
Legal & Business Partnership
- Trusted advisor; practical, solutions-oriented legal guidance; develop scalable legal processes; promote integrity/accountability/compliance.
Qualifications
- J.D. and licensed to practice law in at least one U.S. jurisdiction (active/in good standing).
- 6+ years relevant legal experience (in-house and/or law firm) supporting life sciences/biopharmaceuticals.
- Strong healthcare regulatory/compliance knowledge for commercial biopharma; experience drafting/negotiating complex commercial agreements.
- Privacy laws understanding preferred (not required).
- Excellent written/oral communication; translate complex legal concepts into practical guidance.
- Strong commercial acumen, drafting/presentation skills; international team collaboration; solutions-oriented, sound judgment.
Compensation
- Salary range: $250,000β$275,000 USD (base salary only, per posting).
