Corporate Functions
Role and Responsibilities:
- Counsel internal stakeholders on advertising/promotion, external communications, sales/marketing initiatives, FDA and OIG guidance, and industry codes (e.g., PhRMA) regarding communications with healthcare professionals, payors, patients, and/or patient advocacy organizations.
- Serve as a legal reviewer across MLR committees for assigned products and disease states.
- Independently draft, review, and negotiate commercial contracts to support the Commercial organization.
- Provide analysis, guidance, training, and support to Marketing, Sales, Market Access, Patient Advocacy, Medical Affairs, and Corporate Communications for external communications/outreach related to pipeline and/or approved products.
- Advise on legal issues and risk-mitigation strategies involving advertising/promotion, product liability, anti-trust, and healthcare rules/regulations (fraud and abuse, anti-kickback, False Claims Act).
- Work with the Global Compliance & Ethics Program on counseling and training.
- Assist with compliance risk assessments and investigations; advise on corrective action plans.
- Prepare briefing documents for Executive Management on OIG/FDA enforcement, CIA trends, and OPDP warning and untitled letter analysis.
- Maintain current understanding of applicable pharmaceutical/biotechnology laws and regulations.

Education:
- JD degree and active bar license.

Experience/Qualifications:
- 3–7 years in law firm or pharmaceutical/healthcare legal/compliance; in-house/regulatory agency/major law firm experience welcome.
- Experience supporting pipeline and marketed brands and related statutes/regulations/enforcement trends.
- Experience with AdPromo and as an MLR reviewer.
- Experience drafting/reviewing/negotiating commercial agreements.
- Experience with effective compliance program requirements (OIG Guidance; Federal Sentencing Guidelines).
- Experience with sales/marketing fraud and abuse, OIG guidance, clinical trial regulations, Anti-Kickback Statute, and False Claims Act.
- Strong written/oral/presentation skills; ability to operate in complex environments.
- Strong problem-solving, risk analysis, and project management skills; strong business judgment and ability to partner effectively.
