Assistant General Counsel – Policy, Strategy & Litigation

Responsibilities:
- Define internal legal positions on U.S. drug pricing and government program issues, including 340B, PBM reform, MFN implementation, and programs such as Medicaid Drug Rebate, Federal Supply Schedule, and Medicare Part B/Part D.
- Develop the Law Division’s environment-shaping strategy by coordinating legal, policy, and advocacy tools with internal stakeholders.
- Monitor and analyze federal/state legislative, regulatory, and litigation developments affecting drug pricing, government programs, and access; translate to recommendations for senior leadership.
- Serve as day-to-day legal lead for a defined portion of 340B program implementation (including 340B Integrity Initiative and Credit Model).
- Manage/support HRSA 340B Administrative Dispute Resolution (ADR) proceedings and related legal matters in coordination with Litigation.
- Maintain consistent legal positions on 340B interpretive questions (e.g., covered entity eligibility, patient definition, contract pharmacy arrangements, orphan drug exclusions, duplicate discounts, diversion).
- Identify and help develop affirmative litigation/advocacy opportunities; provide litigation strategy counsel to ensure coordination with broader policy/advocacy strategy.
- Advise on litigation risk and strategic implications of policy positions and program design choices.
- Partner to design and defend internal programs (e.g., 340B integrity/credit programs, PBM-related initiatives) and build records to defend in litigation, agency proceedings, and public/legislative debate.
- Represent the company in trade association working groups and industry coalitions; collaborate with Government Affairs/Public Policy/Communications on legislative/regulatory positions and engage with agencies (Congress, HHS, CMS, HRSA, state agencies).
- Advise senior leadership and integrate legal/policy/litigation strategies across functions; deliver training to commercial, market access, and compliance teams.

Qualifications:
- J.D. from an ABA-accredited law school; active bar membership in good standing in at least one U.S. jurisdiction.
- 8+ years as a practicing attorney, including substantial complex litigation experience and experience developing/executing legal or policy strategy.
- Ability to rapidly master complex subject matter and exercise sound judgment.
- Demonstrated strategic thinking and executive communication; highly collaborative.

Preferred:
- Knowledge of 340B and other federal pricing programs (including Best Price/AMP/ceiling price); direct 340B experience is a plus.
- Experience with PBM reform, MFN, IRA drug price negotiation.
- Experience litigating constitutional/statutory/regulatory/APA matters.
- Experience with trade associations, government agencies, and/or state AGs.
- Federal appellate clerkship.
- Enthusiasm for using AI/emerging technology.
