Responsibilities
- Define Sanofiβs internal legal positions on drug pricing and government program issues, including 340B, PBM reform, MFN implementation, and pricing programs (Medicaid Drug Rebate, Federal Supply Schedule, Medicare Part B/Part D).
- Partner with Law Division leaders to develop environment-shaping strategy combining legal, policy, and advocacy tools.
- Monitor and analyze federal/state legislative, regulatory, and litigation developments affecting drug pricing/access and provide actionable recommendations to senior leadership.
- Serve as day-to-day legal lead for a defined portion of Sanofiβs 340B program (including Integrity Initiative and Credit Model).
- Manage/support 340B HRSA Administrative Dispute Resolution (ADR) proceedings and related matters in coordination with Litigation.
- Maintain positions on 340B interpretive questions (covered entity eligibility, patient definition, contract pharmacy arrangements, orphan drug exclusions, duplicate discounts, diversion) and align them with broader strategy.
- Identify, assess, and help develop affirmative litigation and advocacy opportunities.
- Provide coordinated litigation strategy counsel across the drug pricing/government program docket.
- Advise on litigation risk and strategic implications of policy/program design choices.
- Design and help defend internal programs (e.g., 340B integrity/credit and PBM-related initiatives) and build legal/factual records for defense in litigation, agency proceedings, and public debate.
- Represent Sanofi in trade association working groups and other industry coalitions; collaborate with Government Affairs/Public Policy/Communications on legislative/regulatory positions; engage with agencies to advocate for desired outcomes.
- Advise senior leadership; ensure integrated legal/policy/litigation strategy across functions; deliver training to commercial, market access, and compliance teams.
Qualifications
- J.D. (ABA-accredited) and active bar membership in good standing in at least one U.S. jurisdiction.
- 8+ years as a practicing attorney, including complex litigation experience and developing/executing legal or policy strategy at a global company, government agency, trade association, or top law firm.
- Ability to quickly master complex subject matter and exercise sound judgment.
- Demonstrated strategic thinking and ability to shape positions/strategy.
- Strong executive presence and communication skills; collaborative mindset to build cross-functional alignment.
Preferred Qualifications
- Knowledge of 340B and other federal pricing programs, including Best Price/AMP/ceiling price; direct 340B experience (contract pharmacy, duplicate discounts, diversion, HRSA ADR) is a plus.
- Experience with PBM reform, MFN policy, IRA negotiation, or related reform.
- Experience litigating constitutional/statutory/regulatory/APA challenges.
- Experience engaging trade associations, government agencies, and/or state AGs.
- Federal appellate clerkship or comparable litigation pedigree.
- Enthusiasm for using AI and emerging technology.
