- Provide proactive, efficient, strategic, and collaborative legal advice and support on market access, market access strategy, payer and PBM contracts/strategies, government pricing, and other Commercial-related matters.
- Provide legal guidance on market access strategy development, creation of market access materials, contract drafting/negotiation, government pricing reporting, and interactions with healthcare providers, distributors, pharmacies, payers, PBMs, and GPOs.
- Draft and negotiate commercial contracts including payer/PBM agreements, GPO agreements, distribution agreements, pharmacy agreements, rebate agreements, service agreements, and other corporate agreements.
- Support Commercial teams and Product Attorneys on product-specific Market Access issues.
- Support Corporate Compliance on Market Access issues.
- Maintain an independent and objective perspective while partnering with client organizations.
This Role Requires
- JD with 10+ years relevant legal experience.
- Licensed to practice law in New York or eligible for licensure as registered in-house counsel.
- Prior in-house healthcare/pharmaceutical and/or biotech experience required.
- Significant knowledge of life sciences regulatory enforcement trends; market access strategy; payer/PBM-related issues; payer/PBM contracts; contract operations; government pricing requirements (medical and pharmacy benefit products ideally); regulatory/compliance issues; FDCA; False Claims Act; federal/state fraud and abuse laws; and antitrust laws.
- Excellent interpersonal and conflict resolution skills; ability to work collaboratively.
- Excellent understanding of healthcare laws and experience applying them to complex business situations.
