Role Summary

Legal Senior Counsel, Market Access. Provide proactive strategic and tactical legal support to the business, focusing on market access, government pricing, and policy topics. Support across Market Access, Trade & Distribution, Government Pricing, Government Affairs & Public Policy, and colleagues supporting the clinical pipeline. Remote location in the US.

Responsibilities

  • Provide Advice and Counsel to Business Partners
    • Advise business partners on commercial initiatives that align with strategy while addressing legal risks and protecting integrity and reputation
    • Provide legal counsel on:
      • Market access and reimbursement issues, including contracting with customers involved in distribution of medicines
      • Anti-Kickback Statute and other US healthcare compliance laws
      • Obligations under Medicaid, Medicare, 340B, Veterans Health Care Act
      • Government pricing topics, including price reporting policies and reasonable assumptions documents
      • CMS/Medicare final rules and correspondence, letters, and public comments on proposed rules
      • Federal and state legislation affecting market access, pricing, reimbursement, and state drug price reporting
      • Services and contracting with specialty distributors/pharmacies
      • Data and projects with customers
      • Brand strategic planning and business operation plans
      • Evolving healthcare legislation and enforcement landscape
      • Collaborate with legal colleagues supporting commercial, pipeline and privacy
      • Review internal and external materials as needed
  • Contribute to the Legal & Compliance Department
    • Participate in department projects and committees
    • Share information through group presentations and discussions

Qualifications

  • JD from ABA accredited law school
  • Member of a state bar
  • Minimum 8 years post-JD experience advising on legal matters in life sciences (law firm or in-house) or both
  • 3 years of law firm experience and ability to thrive in a fast-paced environment
  • Experience advising on market access statutes, regulations, and guidance, including anti-kickback, Medicaid/340B/Veterans programs, state drug pricing transparency, OIG guidance, and False Claims Act
  • Excellent communication and ability to provide legal advice to lawyers and non-lawyers, with strong business understanding
  • Advanced contracting and redlining skills with attention to detail
  • Strong analytical, problem-solving, and organizational skills; can manage multiple responsibilities and meet deadlines
  • Experience managing outside counsel and budget adherence
  • Experience providing legal advice on cell and gene therapies and/or specialty medicines is highly desired
