Position Summary
- Director, Commercial Counsel providing comprehensive legal support across marketing and commercial programs, reporting to the Vice President – Legal.

Responsibilities
- Support commercial organization: promotional material review; commercial effort/program risk assessment; counsel on advertising, promotional, sales, and marketing assessments.
- Draft, review, and negotiate commercial agreements (e.g., grants/corporate giving, license, payor/government pricing, commercial enablement).
- Maintain/enhance commercial policies, procedures, and internal controls.
- Provide legal support for commercial growth activities (named patient programs, distribution efforts).
- Partner cross-functionally (Commercial, Regulatory, Finance, HR) to structure and negotiate agreements aligned with commercial objectives.
- Identify and mitigate legal risks; advise on FDA and OIG regulations and industry codes.

Regulatory & Compliance
- Advise on healthcare/regulatory/compliance matters (promotional review, transparency laws, interactions with HCPs/patient advocacy groups).
- Support development/implementation of Patient and Healthcare Provider interaction policies and training.
- Assist with internal investigations and regulatory inquiry responses.

Risk Management & Corporate Support
- Contribute to organization-wide risk assessments and mitigation strategies.
- Manage outside vendor relationships with attention to transparency codes and cost/quality/efficiency.
- Enforce/train on privacy law compliance (e.g., GDPR, CCPA); advise on data collection, storage, and sharing.

Qualifications
- J.D. and licensed to practice law in at least one U.S. jurisdiction (active and in good standing).
- 6+ years relevant legal experience (in-house and/or law firm) supporting life sciences/biopharmaceutical companies.
- Strong healthcare regulatory/compliance knowledge for commercial biopharma.
- Experience drafting/negotiating complex commercial agreements.
- Privacy laws understanding preferred (not required).
- Strong written/oral communication; translate legal concepts into practical guidance.
- Interest in in-house pharmaceutical lawyer practice across relevant law areas.
- Strong commercial acumen, legal drafting, and presentation skills; ability to work on an international team.

Compensation
- Salary range: $250,000–$275,000 USD (base salary only; bonus/equity/benefits only if otherwise provided).
