Patent Counsel (Foster City, CA; onsite/hybrid—3 days in the office)

Specific Responsibilities and Skills
- Develop and implement comprehensive patent portfolio strategies across therapeutic areas, focusing on biologic therapeutics.
- Advise research teams on risks and opportunities related to Gilead’s intellectual property.
- Proactively identify IP issues impacting the business and work cross-functionally to devise and communicate clear advice.
- Perform and use patent landscape and FTO (freedom to operate) analyses; counsel teams on findings.

Specific Responsibilities Will Include
- Oversee and develop patent portfolios to protect product pipeline (biologic therapeutics).
- Draft and prosecute patent applications in U.S. and foreign offices.
- Supervise and manage outside counsels.
- Advise colleagues on patent strategy and identification of patentable inventions.
- Partner with patent informatics on FTO/patent landscape searches.
- Review and assist drafting/negotiation of nondisclosure, research, license, and other IP-related agreements.
- Review proposed publications for potential IP issues.
- Prepare and conduct IP presentations.
- Assist with procuring/advising on regulatory exclusivities and data protection.

Education & Experience Requirements
- Juris Doctor from an accredited law school; admission before a State bar.
- Admission to practice before the USPTO.
- Bachelor’s degree in biology/biochemistry/chemistry or related sciences; advanced degree in biochemistry or molecular biology is a plus.
- 4+ years global patent prosecution and patent application drafting (protein biochemistry/pharmaceuticals/biotechnology preferred). Small-molecule experience is a plus.
- Experience preparing/prosecuting applications focused on biologic therapeutics.
- FTO and patent landscape analysis experience.

Benefits (explicitly stated)
- Salary range: $226,185.00–$292,710.00; may be eligible for discretionary annual bonus and long-term incentives; paid time off and benefits package including medical, dental, vision, and life insurance.
